Morals and Beliefs in Gran Torino

Gran Torino Essay Values are principles that a person lives up to. It shapes and defines who they are. Moral refers to issues of right and wrong and how individual people should behave. Moral values are one of the most important things that we human beings live for. The movie â€Å"Gran Torino† is an excellent example of how our own moral values define who we are as a person. We make decisions based on what we think is right or wrong. The film starts off with Walt Kowalski who is a widower who holds onto his prejudices despite the changes in his Michigan neighbourhood and the world around him.Kowalski is a grumpy, tough-minded, unhappy an old man, who can't get along with either his kids or his neighbours, a Korean War veteran whose prize possession is a 1972 Gran Torino he keeps in mint condition. When his neighbour Thao, a young Hmong teenager under pressure from his gang member cousin, tries to steal his Gran Torino, Kowalski sets out to reform the youth. Drawn against his will into the life of Thao's family, Kowalski is soon taking steps to protect them from the gangs that infest their neighbourhood.The film has excellent examples of moral values throughout the development of the main characters such as courage, equality and selflessness. Courage is shown throughout the film countless times. No-one can say to another individual that their morals are wrong. No one’s moral are wrong, our morals stems from our perspective of what things are supposed to be not someone else’s view on morals. Though in the movie, Thao shows courage by trying to steal Walt’s prized car. Even though it’s a wrong decision to make, he shows courage and attempts to do it. It’s a value that we would all want. To show courage in the face of fear itself.Courage is a very hard thing to come by, not many people have it but Thao demonstrates this even though it was wrong however he rights his wrongdoing. Walt also shows courage throughout the film s uch as when he beats up one of the gang members even though he is well aware of what they are capable of. The film portrays courage not only by using the actors but also film techniques such as camera shots. When a character is expressing bravery, the camera closes up on his or her face to show the emotion and expression in the eyes and facial movement. It helps the audience interpret the courage on a characters face.Courage is moral value present in the movie. Equality is another value we hope to come by. The film evolves from racism to equality. When Sue befriends Walt, she sees him as an equal not as someone who is below her. Though their races are different, they show an understanding towards one another and they don’t discriminate each other. They respect each other and therefore show equality towards each other. That also happens with Thao when he gets to know Walt. Walt shows an understanding to Thao when they grow closer and even regards him as a friend. Equality is n ot always present in the world but it can be achieved.Even the neighbours of Walt, grew to have an understanding with him who at first despised him to be white. However equality is eventually a value that not only Sue but also Walt, Thao and their neighbours possess. The film demonstrates equality as a need in this world. Finally, one of the most important moral values a human being can possess is selflessness. It is when a person puts someone else’s needs before their own. In Gran Torino, one of the most heartfelt and saddest moments was when Walt sacrificed his life for Thao and the neighbourhood. He knew that if Thao went after his cousin â€Å"Spider† he would die.So Walt decided that he needed to do this not only for himself but for the whole neighbourhood. He came to confront Spider and the gang, he spoke very loudly to provoke the whole neighbourhood and have witnesses for what he was about to do. He asked if anyone had a lighter, he then reaches into his pocket s, as he does this, the gang reaches for their gun in preparation. Walt grabs out his lighter but making it look like he was pulling out a gun from his inner pocket, then without hesitation the gang members had shot him. He was never armed and so the gang were charged and went to jail.This sacrifice that Walt made was very admirable and was probably his most important morals. He believed in putting someone else’s safety before his own. This was a moral value that was the most important within the movie. In conclusion, these three values were demonstrated as the film progressed. It shows that a person who believed in their own moral values can be regarded as a hero. By following and believing in their own morals, it goes to show that you can help not only yourself but those around you. Gran Torino was an excellent movie about how a person who followed their morals can help those in need.

In just one year after the president first took office, the No Child Lefty behind Act (NCLB) passed overwhelmingly. No Child Left Behind has led to higher standards and greater accountability throughout the nation’s school systems. No Child Left Behind provides the schools with more funding, gives states and school districts more control and more flexibility to use resources where they are needed most, holds schools and school districts accountable for results, and may provide your child with free tutoring and extra help with school work. When it comes to improving education in our state I believe our priority is to improve teaching, make better finical investments in our education systems, and coming up with better way to get students more involved and excited to learn. I believe we need to look at how much we’ve already spent and what were using the money for and evaluate what we are receiving in return. Opening college doors to more high school students who don’t have the funds to pay for it themselves is also another way in improving education in our state, allowing more students to have the opportunity to receive a decent education. Offering more and specific work related classes that interest the student and offering high more challenging courses for the students as well. But its not just about what the state and community can do, but its also up to the parents. Parents and Guardians play a big part in helping improve our education systems. The role of parent and parental involvement in improving education in our state is being involved. Regardless of the family income or background students with involved parents are more likely to earn higher grades and test scores attend school regular basis. Students with involved parents tend to have better social skills, improved behavior, and graduate on time and attend college. Children who have parents who aren’t there to push and motivate them don’t make it quit far. Parental support is always needed and a big part of parental involvement. If your parent doesn’t care about your education or is involved regarding you education you’re going to feel as if it’s not so important. Parents can become more involved by talking to their child and the child’s teachers, making sure they know who is giving their child the education and to be sure the child is working to their best of their ability. Physical environment affect school climate and student achievement by depending on what goes on inside or outside of school of the school will the feelings expressed by students, teachers, staff and parents about school. If the child is placed into a negative environment outside of school there’s a big guarantee that it will be brought back into school by that child. There’s also a chance that other students may pick up vibes from another student rather its negative or positive. When the child is placed into a good positive environment outside of school more than likely he or she will feel more better about themselves and bring that attitude back into the school as well. A well disciplined environment, learning environment, social environment, and school-community relations all affect the schools climate and the achievements of the students who attend. When students have to travel outside their neighborhood to attend a great school their family looses time, money, and energy. To put your child in a school that is better than their neighborhood schools probably cost more and is a bit embarrassing to the community or area you reside in. You’re using more gas to provide your child transportation to attend this school. It also takes up more time to take and pick your child up from a school that’s more than 20 minutes away from where you live. Now with a lot of students coming from poorly educated schools to attend the good schools they are making the â€Å"good† public schools in that particular area look bad. Most Africa-American communities don’t care about attending school or getting a good education. Everyone wants to make it out on their own but it seems as if the younger generations don’t want to make the first step in receiving a good education. They don’t take getting a education as serious as they should. But not all African Americans in a community feel that way. I believe the African-American communities stand beside other communities in America with the problems in the system. I believe the African Americans stand beside other communities because most of them don’t care. From the looks of things I believe most African-Americans have the wrong mentality about school and life.

Grape Farms in Jaffna (Sri Lanka)

The dying art of Jaffna â€Å"The next generation is not keen on getting their hands dirty and they dislike hard work. They do not want to take up the field of farming. They prefer being in air conditioned offices or being doctors and lawyers. They have dreams of their own and being a grape farmer is hardly one of them† For thirty long years Sri Lanka was torn apart by a malevolent war between the country’s majority and minority; a war that not only claimed the lives of many, soldiers and civilians alike, but also destroyed much property and dammed the country’s growth in uncountable ways.The whole of Sri Lanka grieved as one at all that was lost but it would not be incorrect to say that it was the north that suffered the most; it affected the education, economy, health, security, agriculture and overall the lives of the people of that part of the island. One trade that was deeply affected in the field of agriculture is grape farming, an industry that was and is carried out at a commercial basis only in the district of Jaffna. It was stated by Mr. Sivakumar, Provincial Director of Agriculture Northern Province, that before the war the district of Jaffna had over 250 acres of grape cultivation.The war brought upon difficulties in marketing the crops which resulted in gradually increasing numbers of farmers leaving the trade as it was no longer profitable. However since the ending of the war and the opening of the A9 road, new marketing prospects have been found and the trade has yet again been taken up and currently is spread over 110 acres in Jaffna. While cultivators who lost their farms during the war have been given the opportunity to revive their lost businesses, new cultivators too are being encouraged to take up the trade by the government said Mr.Sivakumar. The Ministry of Agriculture Northern Province is currently focusing on introducing new varieties of grape fruit to Jaffna farmers in order to harvest better crops. These new varie ties Sonaka and Sharad have been imported from India and are said to produce grape fruit that is larger in size and sweeter than the local grapes. This idea of importing new varieties has been supported by the Central Department of Agriculture which is the agency that gives permission for importing any sort of planting material, and also by the Ministry of Agriculture.The financial support has been given by Cargills food city as it is them who invested in the project. The total project investment has been Rs 222 million and 92. 2 million of this investment has been shared by the USAID. The imported seedlings have already been introduced, distributed and promoted among Jaffna farmers and is currently being cultivated and within another two years the peninsula will have a greater variety of quality grape fruit, noted Mr. U. L. M Haldeen, Secretary of the Ministry of Agriculture Northern Province.Grape crops are harvested twice a year; during the season of March- April and August- Sept ember. These are considered peak periods as it is the dry season during these months and for grape fruit the dry season is considered very important as this is the time that produces the best crops. However certain farmers prune in such a way that they can produce crops even off season. Grape cultivation, compared to other farming industries needs a fair amount of investment and effort to inaugurate and to maintain. To grow a quarter acre farm it costs approximately 150 thousand Rs just to install the pandal system.For the maintaining of such a farm it costs about another 150 thousand Rs stated Mr. Sivakumar. Even though it is a costly trade it brings in enough money to be called a profitable trade. Farmers have reported that a quarter acre farm brings in nearly 200 thousand Rs per season. This good income is one of the main encouraging forces for other cultivators to begin grape farms of their own which in return will increase the overall crops produced by Jaffna which would prove to be healthy for the economy of the district.On a positive note, locally grown grapes are cheaper than the imported ones as a kg of Jaffna grape fruit costs 200 to 300 Rs while the Australian imported grapes cost 600 to 700 Rs. However on the contrary the imported grapes are much larger in size and taste sweeter than the locally grown Israel Blue. Therefore, even now, customers who look for quality are willing to pay more to purchase the imported fruits, which pose a threat to the growth of the local grape fruit farming trade. This is the reason as to why he ministry is trying all possible options to grow grape crops that can compete with the imported ones. As there is already a fairly good market for Jaffna grapes in the southern part of the country it is their hope to widen this market by dominating the imported grape fruit market. As earlier mentioned maintaining a grape farm is both an expensive and difficult venture. Especially to the farmers of the north it is something much more than just a trade, it is a significant part of their lives. They have many beliefs and traditions entwined with the grapevines.It is said by these farmers that growing grapes is in many ways much like raising a child; it requires constant nurturing, caring and attention. There is a manner in which every move should be made: choosing the soil, installing the pandal system, preparing the drainage, watering the farm, fertilizing, and last but not least pruning should all be done in a proper manner to ensure the well being of the grapevines says Mr. Inuvil, a successful grape farmer. The preciseness of this trade makes it appear that grape farming in actuality is more or less an art than just an agricultural trade.Even though the number of farmers stepping into this field is on an increase, according to farmers the future of the industry remains uncertain. It is because of the lack of young farmers who are willing to follow in the footsteps of their precursors. Today’s youth is much more commercialized and they crave ways of earning riches in much easier ways than laboring away in farms and fields under a scorching sun. Another reason for the possible declining of future farmers is the perception that agriculture is an unprofitable or oor industry to be in as this is often the image that is projected by t he media and otherwise, however many successful farmers like Mr. Inuwil would strongly disagree. According to him, it is a matter of willing to be hard working, committed, sacrificial and patient; all traits that he says most of the younger generation lack. In a classroom situation an activity can be developed in such a way that it has a sequence of activities that kindle different intelligences simultaneously. For instance, a blue print of a house plan is shown to the students and in the first step they are asked to study it (mathematical/logical) then they are asked to describe the plan (verbal) in step three the students are asked to discuss and share ideas (interpersonal). Conclusion Thus, as a teacher I think that incorporating the multiple intelligences concept into my lesson plan will certainly help me in judging the level of student's interest in a specific area and adopt a mode of teaching suitable to the individual in particular or a class as a whole. Prevalence of smoking and drinking Essay Adolescence, from Latin word adolescere which means â€Å"to grow up† is a transitional stage of physical and psychological human development generally occurring between puberty and legal adulthood. It is most closely associated with teenage years. Adolescence is further divided into three more stages, the early (12-14 years old), middle (15-17 years old) and late adolescence (18-20/21 years old). In each stage of human development, there are physical, emotional and physiological changes that happen. This is based from the concept that humans have developmental tasks that should be accomplish per stage. In the adolescence stage, adolescents are in critical stage because teenagers are exposed to a larger environment (Macmillan Dictionary for Students, 1981). Background of the study Nowadays, teenagers that are exposed to different environment are now engaged to smoking and drinking alcoholic beverages for some reasons. The strong association between binge drinking and smoking among adolescents may be attributable, in part, to the fact that both adolescent alcohol use and tobacco use share a number of sociocultural risk factors. Researchers have found that these factors—including family and peer influences, demographics, advertising, economics, and alcohol and tobacco availability—are associated with adolescents’ initial and continued tobacco and alcohol use (Bobo, J. and Corinne Husten, 2000). According to the U. S. Surgeon General Report (1994), approximately 80% of adult smokers started smoking before the age of 18. Every day, nearly 3,000 young people under the age of 18 become regular smokers and an estimated 2. 1 million people began smoking on a daily basis in 1997. More than half of these new daily smokers were younger than age 18. This translates to more than 3,000 new youth smokers per day. The rate of youth initiation of daily smoking increased somewhat from 55. 5 to 74. 9 per 1,000 potential new users between 1991 and 1996, but remained level in 1997 (the 1998 National Household Survey on Drug Abuse). It is said that young people who come from a lowincome family and have fewer than two adults living in their household are especially at risk for becoming smokers and those with poorer grades and lower self-images are most likely to begin. using tobacco. Over the past decade, there has been virtually no decline in smoking rates among all teens. Among black adolescents, however, the prevalence of smoking has declined dramatically. Most young people who smoke are addicted to nicotine and were reported that they want to quit but are unable to do so (Statistics on Teens, 1994). In 2002, Komro and Toomey said that alcohol use by underage drinkers is a persistent public health problem in the United States, and alcohol is the most commonly used drug among adolescents. Accordingly, numerous approaches have been developed and studied that aim to prevent underage drinking. Alcohol use initiation rates for children rise quickly from age 10 up to about age 13, when they reach more than 50 percent. Subsequently, initiation rates begin to slow again (Kosterman, R. et al. , 2000). Moreover, alcohol is the most commonly used drug among adolescents. According to Epstein, J. et al. , alcohol use continues to be an important public health problem. Recent national survey data indicate that 41% of current 8th graders, 62% of 10th graders, 73% of 12th graders and 85% of college students have used alcohol. Even more troubling is that 11% of 8th graders, 22% of 10th graders, 25% of 12th graders and 40% of college students reported heavy episodic drinking. Domingo and Marquez found large gender differences in the risk-taking behaviors among Filipino adolescents and youths. Men are much more likely than women to drink, smoke, and use drugs. The large gender difference in risk-taking behavior among adolescents and youths is rather common in Asian countries but not in the U. S. In our case, The Philippines has no national law regulating smoking and sale of tobacco products. There is no minimum age requirement for the purchase of cigarettes and no law regulating the advertising and promotion of cigarettes. There is no law that requires the printing of warning labels on cigarette packages. Instead, the National Tobacco Administration (NTA) is supposed to protect and promote the â€Å"balanced and integrated growth† of the tobacco industry. Despite the results of a survey which say that 72 per cent of the polled adult population was supportive of having a legislation banning smoking advertisements. There are more restrictions on drinking than smoking especially of the minors. Those who are less than 18 years old are 2|Page prohibited from purchasing or drinking alcoholic drinks. However, the enforcement of this regulation is weak (Choe, M. and Corazon Raymundo, 2001). Objectives This study aimed to determine the prevalence of smoking and drinking of alcoholic beverages among senior high school students specifically: 1. to compare the prevalence of smoking and drinking of alcoholic beverages between senior students of public and private high school; 2. to contrast the occurrence of smoking and drinking alcoholic beverages among senior high school males and females; 3. to identify and rank the reasons why senior high school students smoke and drink alcoholic beverages; 4. to determine the awareness status of senior high school students in terms of the effects of smoking and drinking alcoholic beverages on their physiological health; and 5.to identify the effect of smoking and drinking of alcoholic beverages on the socialization of senior high school students. Review of Related Literature There are different factors affecting different behaviors of adolescents. One social theory studied by Travis Hirschi (1969) is a more general explanation of deviance than deterrence theory, but which is, in turn, primarily restricted to informal social control which comes from individuals being bonded to groups and institutions. 1236 grade 9-13 students from 62 randomly selected classrooms in 3 Canadian schools in the Borough of East York, 1 of Metropolitan Torontos 6 municipalities, were surveyed in December 1994 about their alcohol drinking beliefs and behaviors, and related lifestyle behaviors. Findings are based upon the analysis of data from 628 boys and 608 girls, of whom 799 were born in Canada. 24% of the students reported never having tasted alcohol, 22% had tasted alcohol but were not current drinkers, 39% were current moderate drinkers, 11% drank at 3|Page least 5 drinks per occasion at least once per month, and 5% did not answer. The most often stated reasons for not drinking were family upbringing and they believed adverse effects of alcohol consumption upon health, while the most often stated reasons for drinking were because it is an enjoyable experience and to get into a party mood. Respondents drinking patterns were significantly related to gender, ethnicity, grade, and the reported drinking habits of parents and friends. Older male adolescents who describe themselves as Canadian are more likely to drink heavily than are students who are younger or female, or self-identify as Asian or European. Current heavy drinkers are at greater risk than other students of engaging in other high-risk behaviors such as drinking and driving, riding with an intoxicated automobile driver, and smoking every day (Feldman et al. , 1999). In one of the surveys in US, half of respondents knew of a place near their school where kids could go to drink and get high during the school day, according to the yearly back-to-school survey, which polled 1,003 12-to-17-years old. And more than one-third said that students had ample opportunity during the school day to drug, drink and smoke without getting caught. Drug use in both public and private schools is on the rise, with 54 percent of private high school students reporting that drugs are available in their schools versus 24 percent in 2002 and 61 percent of students at public schools saying their schools are drug infected, compared with 46 percent in 2002. The researchers looked closely at the role of social media in teen substance use and found 75 percent of surveyed 12 to 17-year-olds said seeing pictures of teens partying with alcohol or marijuana on social networking sites such as Facebook or MySpace encourages them to party similarly (Gardner, 2012). Forty-five percent of teens almost 11 million said they have seen such pictures online and 47 percent of those teens said that it seems like pictured teens are having a good time. Teens who have seen these pictures were found to be four times more likely to have used marijuana, more than three times likelier to have used alcohol, and almost three times more likely to have used tobacco (CBSnews, 2012). 4|Page In the awareness of teenagers on the health risks of smoking and drinking, it was found in one of the studies that teenagers think that smoking is more dangerous than smoking. Teen smoking has declined in all three grades included in the study—grades 8, 10, and 12. Still, almost 19 percent of 12th graders reported current (past-month) cigarette use. This decline shows that more teens realize the harm smoking does to your body and are making the decision not to start. Also, teens’ attitudes about smoking have changed. They increasingly prefer to date nonsmokers and believe smoking to be a dirty habit. Likewise, among nearly all grades, trends over the past 5 years showed significant decreases in alcohol use, including first-time use, occasional use, daily use, and binge drinking. As with smoking, this decline may be the result of more teens understanding the risk of drinking alcohol and disapproving of this behavior (The Sara Bellum Blog, 2012). How teenagers feel about themselves plays a significant role in whether they choose to drink or use other drugs, according to a new report released today by SADD and Liberty Mutual Group. The Teens Today 2003 study also reveals that a teen’s Sense of Self, can influence sexual behavior, reaction to peer pressure, and, importantly, be affected by a teen’s relationships with parents (Henderson and Greenberg, 2004). Research has shown that the media over estimates smoking rates and often associates smoking with favorable attributes or situations. Given that the media plays a large role in influencing youth culture, portrayal of smoking in the media is of concern. In order to explore young people’s perceptions of smoking imagery in the media, 16 focus groups were conducted with 117 school students. Participants were asked to rate smoking images selected from audiovisual and print media, and to discuss their perceptions of these images. The results showed that young people perceived smoking in these media selections to be normal and acceptable. They identified with the stress relieving and social aspects of smoking, despite being well aware of the harmful health effects. Its acceptability as part of a ‘cool’ image was also noted. Positive images of smoking in the media have the potential to down play the serious health consequences of smoking by portraying it in a way that young people interpret as a 5|Page normal part of everyday life. They may also encourage a more neutral or tolerant attitude towards smoking among young people and therefore act to counteract other health promotion efforts to reduce teenage smoking (Watson et al., 2003). 6|Page METHODOLOGY The Participants In the study of determining the prevalence of smoking and drinking alcoholic beverages among senior students from private and public high schools, a total of forty senior high school students, twenty students comprising of ten male and ten female students from public high school and twenty students comprising of ten male and ten female students from private high school were randomly asked to answer the questionnaires provided by the group. The public school was a public national high school located in Los Banos, Laguna. On the other hand, the private school is a registered private non-sectarian high school in Los Banos, Laguna as well. The respondents have a mean age of 16 years old, ranging from 15-18, having a mode of 16. Measures The most commonly used and most frequently self devised measuring instrument, the questionnaire was used simply to obtain information directly from subject as to make a standardized list of factual information or elicited application that was generalized to a larger population. A one-shot survey questionnaire was used as the research instrument in the study of determining the prevalence of smoking and drinking alcoholic beverages among senior students from private and public high schools. It is a usual study design where a single group of individuals is selected for observation over a single, limited time period, usually because they have experienced some factor taken as important in shaping some outcome (Kelly, 2012). And according to Jupp (2012), it is akin to one-off crosssectional design. As shown in Appendix A, a letter to the respondent identifying our topic and informing our objectives were told. Moreover, see Appendix B for the complete copy of the questionnaire used in the study. 7|Page The questionnaire was divided into three parts: Personal information, Physiological status and Lifestyle, and Social Aspect. The Personal information section was used for determining the age, sex, type of school, religion, and parents’ civil status. While in the physiological status and lifestyle section, this would tell us how often the students from private and public schools smoke and drink alcoholic beverages. Also, to find out if the students were aware of the effects that these specific vices can contribute to their health condition. Lastly, the way of smoking and drinking alcoholic beverages of the students in terms of having a companion or not while smoking and/or drinking and the perceptions of parents and themselves were determined in the Social Aspect section. The Setting The researchers had entrusted the set of questionnaires to one of the respondents from public and one from private high schools. They were the ones who distributed the set questionnaires to their fellow senior high school classmates. The respondents were a given a whole day time to answer the survey questionnaire. The two entrusted students collected all the completely answered survey questionnaires at the end of the day. Data Analysis In the process of obtaining, the questionnaires were made, distributed and collected again. For a more simple analysis of the data collated, tallying was made in a tabulated manner. The data obtained were computed to get the percentage by dividing the number of score with the sum total of scores and then multiplying it by 100% using the formula: P = f / N x 100% Where: P – Percentage N – Total number of respondents F – Frequency 8|Page And lastly, for an easier glance to the data collected, it will have a graphical presentation in a form of bar graph, pie chart and other usual graphical ways to present the data. In order to identify the reasons why they smoke and what they think their parents perceive them a list of possible choices were mentioned in the questionnaire. These reasons were ranked 1 to 3 by the respondents who are smoking and/or drinking alcoholic beverages. In order to evaluate the rankings, an improvised rubric is formulated. Every number (rank) has an equivalent vote just to differentiate and identify the leading reasons. Rank 1 – 3 points Rank 2 – 2 points Rank 3 – 1 point The highest vote will be assigned as the top reason while the others will be ranked according to the accumulated votes. The tabulated rank can be found on the results and discussion. Other data, including the occurrence, prevalence, frequency, reasons, and perceptions of male and female senior students smoking and drinking alcoholic beverages among private and public high schools were tabulated and graphed in order to see the comparison. While in determining the awareness of the students if smoking and drinking alcoholic beverages had an effect on their health condition, and if they were able to gain friends were in a form of poll. 9|Page RESULTS AND DISCUSSION The prevalence of smoking and drinking alcoholic beverages among senior students of public and private high school were determined and observed. As seen in Table 1, the total number of students smoking is 3, with 2 females and 1 male in public school. While 4 students, with 3 males and 1 female in private school. Among the 40 students, 7 of them were smoking. Table 1. However, that does not mean that all of them are aware on certain issues present in the status quo today. Figure7 shows us that in terms of awareness of male and female students in the effects of smoking to the health condition, 95% said that they are aware, and 5% said they are not aware. While it is important to know the reason why some adolescents smoke and/or drink alcoholic beverages, and after knowing if they were aware that these things affect their health conditions. We also have to look at the perceptions of people around them, and also what they think of themselves. In contrast to awareness of the respondents in the negative effects of smoking and drinking on health condition is their way of performing these vices, either alone, with friends, or both. Fig. 9 and Fig. 10 shows the way of drinking and smoking of public and private high school students respectively. It is observed that 53% or the majority of the students engage in drinking with friends, and 80% of them smoke either alone or with friends. The least vote was they thought that their parents think their children were bad. This means that even if they’re doing those kinds of vices, their parents still accept them. It is observed that what they think their friends perceive also had the same result as to how they comprehend themselves when they smoke or drink. As seen in Figure 13, majority of them still thought that they are good. However, 6% of the students thought they are addicts. But, it is still significant when it comes to application or reality. Are these students still gain friends after all their vices? In a poll seen in Fig. 14, 9 out of 15 said that they gained friends, and 6 out of 15 said that they did not gain friends. Meaning, there people who discriminate or dislike the vices. However, there are still some who don’t. 24 | P a g e LIMITATION AND SIGNIFICANCE Limitation There are certain problems that were encountered in the study. One of which is that the idea that honesty in answering these questionnaires have suffered. The respondents may or may not answer these questionnaires in full honesty. From here, we may have little discrepancies or percentage errors. Significance The significance of this study is for the teenagers to be aware in terms of the effects of smoking and drinking alcoholic beverages on their physiological health. This study can also help the parents of those teenagers to understand more the point of view of teenagers who are engaged to these activities. They can know the cause why teenagers are into smoking and drinking alcoholic beverage. 25 | P a g e SUMMARY, CONCLUSION AND RECOMMENDATIONS. Summary and Conclusion The study was able to conduct the research on the prevalence of smoking and drinking alcoholic beverages among senior students of public and private high school. 18% of the students in both public and private schools are engaged in smoking; however, there are students in private schools who smoke more than students in public schools. It is concluded that the social status of the students is a common factor since private school students have more access to cigarettes and could afford it than those in public schools. It is also determined that the male students in private schools and the female students in public schools are more prone to the said vice and their main reasons were: (1) to experiment; (2) peer pressure; and (3) imitated from their parents. With regards to their way of smoking, the students’ general frequency is 1-2 times a week, and they usually smoke either alone or with peers. Most likely they tend to smoke with their peers because it is their way of socialization. The students also perceive that they are also likely to gain friends when they smoke. It is concluded that the perception of the students to what their parent think of them is â€Å"in-the-trend† when they are engaged in smoking. The majority thinks that their parents consider them as â€Å"cool† or â€Å"sophisticated†. Aside from that, the respondents think that their friends refer to smoking in a good way, causing them to also perceive the same judgment. To summarize the above statements, it is evident that the students in their adolescent stage have more desire to please their peers rather than their parents because they want to have a sense of belonging and they want to socialize more with people of the same age group. Peers are the most important relationship in the teenage years. They engage in different kinds of activities, and one of those are vices. In this stage, the curiosity level of the person is prominent because he/she is able to perceive different kinds of activities from various types of people. Parents are also a factor because they are the ones who nourish their child’s well-being. What they do causes 26 | P a g e various impacts on the child, causing him/her to either imitate it or not. The social status of the students also has an effect on their engagement in vices; it depends on how well they can afford it and on what terms they could get access. The Video Game Controversy Media Essay The video game controversy has been an ongoing debate with one side insisting that video games increase violent tendencies amongst children and the other debunking it. Timothy F. Winter blames video games for violence amongst children in his article The Government Should Stop Kids From Buying Violent Video Games, published in U.S. News and World Report on 10th May 2010 while Michael D. Gallagher insists otherwise in his article, Video Games Dont Cause Children to be Violent, published in U.S. News and World Report on 10th May 2010. Both articles are directed towards parents as the topic concerns children and whether they are affected by video games, a common form of entertainment in any given household. This essay will critique the strengths and weaknesses of the articles with regard to how the authors used the rhetorical proofs of ethos, pathos and logos. Though Winter is better at using pathos in his article than Gallagher, his argument contains fallacies which weakens his argument considerably while Gallaghers article is reinforced by his usage of logos. The rhetorical proof ethos can be categorized to three different parts, that is, initial ethos, derived ethos and terminal ethos (McCroskey, 2004). McCroskey (2004) defines initial ethos to be the ethos of the source before the communicative act, derived ethos as the sources ethos during the act of communicating and terminal ethos to be the sources ethos at the completion of the communicative act. Ethos plays an important role in an argument because the audience judges not only the argument, but the speaker as well (Borchers, 2006). The key factors in constructing a believable ethos are source credibility, prestige and personal proof (McCroskey, 1997) and as Gallagher is the president and CEO of the Entertainment Software Association, a company that deals exclusively with video games (The Entertainment Software Association website, 2010), he is more than qualified to give his opinion on the subject thus he has high initial ethos. Winter is the president of the Parents Television Coun cil and though that organization advocates most forms of entertainment, its primary focus is television (Parents Television Council website, 2010) so his initial ethos is not as high as Gallaghers. Winter and Gallagher both have derived ethos because during the body of their articles, they both include factual material and opinions attributed to qualified sources (McCroskey, 2004). Winter cites findings from the Federal Trade Commission (FTC), the Parents Television Council and the California Legislature. Gallagher includes sources from the Supreme Court, FBI statistics, the U.S. Ninth Circuit Court of Appeals, a quote from Hon. Robin Cauthron of the United States District Court, and the FTC. Both Winter and Gallagher have terminal ethos because as a representative of the Parents Television Council and Entertainment Software Association, they manage to make their corporations look good through their arguments. Winters stance on video games is that it encourages violence amongst children due to the flaws in the rating system while Gallagher firmly believes that the rating system will prevent children from playing violent video games. Both writers are slightly biased in their articles in supporting their stance but Winter is noticeably more so than Gallagher. Winters article may offend the percentage of his audience that are gamers as he states that, The industrys arguments are logically and morally bankrupt. Reinking, Hart and von der Osten (1999) point out that if the writers tone is mean or arrogant, it offends the public and will fail to persuade the public. Winter is sarcastic and snide in his comments about the video game industry in his article. Gallagher expresses his genuine concern for the subject as he believes in finding a solution to the problem and is generally respectful to the audience. To appeal ethically to the audience, one has to be committed to the truth, have sincere re spect for others and to be concerned about the issue (Reinking, Hart von der Osten, 1999). Thus from an ethos standpoint, Gallagher is better at backing up his argument with ethos than Winter. Ramage, Bean Johnson (2004) associates pathos with emotional appeal which focuses on making the audience feel what the writer feels. They further state that pathos relies on the audiences imaginative sympathies. Gallagher concludes his article with a sentence that will appeal to the audiences sympathies, Americans rights to speech and expression are sacred and inviolate- millions across the political spectrum agree with us. His audience, Americans as this article appears in the U.S. News Report, are being emotionally manipulated to believe that those opposing Gallaghers argument are suppressing their freedom of speech. He is relying on the audience to sympathize with the video games industry as they are being oppressed. Thus Gallagher has developed some pathos in his argument, as he knows his audience and how to sway their emotions (Borchers, 2006).Winter also displays a knack for utilizing this rhetorical proof as he describes in length the violent acts one can commit when playing a video game such as shoot a police officer and urinate on him as he tries to crawl away. The examples he gave serves two purposes; it provides evidence that supports his reasoning and it also gives his argument presence and emotional resonance (Ramage, Bean, Johnson, 2004). Winters inclusion of specific details in his argument can help to create an image in the audiences minds that will trigger their feelings (Ramage, Bean, Johnson, 2004).Winter uses terms like ultraviolent video games to further insinuate his message to the audience that video games are a negative form of entertainment that focuses on violence. Reinking, Hart and von der Osten (1999) affirm that pathos can be used to drive people to action, people who would otherwise passively accept an argument based solely on logic. Winters graphic details will cause parents to be against video games because they would not want their children to participate in these violent actions. Gallagher attempts that strategy as well when he indirectly accuses his opposition of taking away Americans freedom of speech by condemning the video game industry because video games are considered to be media too. However, the rest of Gallaghers article lacks pathos as he does not attempt to connect with the audience as much as Winter. Therefore, Winter displays a better use of pathos than Gallagher in his article. Though both Winter and Gallagher have used the rhetorical element of logos in their arguments, Gallaghers use is stronger as Winters article contains fallacies that weaken his argument. Logos refers to the internal consistency and clarity of the message and to the logic of its reasons and support (Ramage, Bean, Johnson, 2004). Gallagher makes a good point when he states that the video game industry has a rating system that informs and empowers parents. He believes that parents should be in control of deciding what their kids are allowed to play and that the rating system will enforce that. He backs up this argument by stating facts from the FTC like how 87% of parents were satisfied with video game ratings and that the FTC has applauded the video game rating system because it clearly displays rating information and restricts childrens access to mature-rated products. In his article, Winter uses refutation to this claim, that is, the practice of countering an argument with evidence o r reasoning (Borchers, 2006) by stating statistics from the Parents Television Council that indicate that an underage child is able to purchase a mature game 36% of the time. Winter is framing his evidence; he is maximizing his readers focus on his data and is guiding his readers vision and response (Ramage, Bean Johnson, 2004). However, Jenkins (n.d.) points out that the FTC has found that 83% of games purchased by underage consumers are made by parents or children accompanied by parents. Parents are responsible in restricting the access of mature-rated games from children and Gallagher points out that the video game industry is working to help parents as current-generation game consoles come with built in parental controls that allow parents to block video games they do not want their children to play. He states that major U.S. retailers are also working to help parents by enforcing age restrictions in the purchase of games. Though a functioning and praised rating system exists f or the video game industry, Winter is not satisfied because he is of the opinion that children will continue to be able to play violent video games. Gallaghers article consistently debunks the statement that video games cause violence amongst children and he supports himself by including FBI statistics that confirm that youth violence has declined in the recent years as video game popularity has increased. However, Winters article confirms that more than 3000 studies links violence tendencies amongst children to the consumption of violent media. Jenkins (n.d.) states that though much research has been done on whether video games contribute to violence amongst youth, most of this research is inconclusive and have been criticized on methodological grounds. He concludes that no research has found that video games are a primary factor in increasing violence amongst children and turning them into killers. Ramage, Bean and Johnson (2004) discuss universal quantifiers, which is the tendency to confuse universal quantifiers with existential qualifiers. As Winter ignores the fact that playing violent video games is not the sole cause for violence amongst children, he is guilty of this fallacy. Gallagher refutes Winters statement by quoting the U.S. Ninth Circuit Court of Appeals, The state has not produced substantial evidence thatviolent video games cause psychological or neurological harm to minors. Thus Winter is begging the question, that is, a fallacy where he asserts the truth of an unproven statement (Reinking, Hart von der Osten, 2004) when he states that video games increase violence tendencies amongst the youth. Not only that, Jenkins (n.d.) points out that the most studies on violent video games found is a correlation, that aggressive people like aggressive entertainment. Winter is also guilty of the fallacy post hoc, ergo propter hoc, which is confusing the correlation for the cause (Ramage, Bean Johnson, 2004). Winter brings up a very good point in his argument, that video games are different from other forms of entertainment because the player is actively engaging in the violent acts rather than just watching it onscreen. Children who are playing violent video games choose who to beat, rape, maim or kill and Winter reasons that because of this unique problem, the government should do more to prevent children from playing adult games. Winters reasoning is linked to the audiences values as parents would not want their children to play these violent games and as such he is persuasive (Ramage, Bean Johnson, 2004). Gallagher tries to claim otherwise by quoting the Hon. Robin Cauthron of the United States District Court, the presence of increased viewer control and interactivity does not remove these games from the release of the First Amendment protection. However his claim does not prove anything, just that video games are entitled to freedom of expression thus it is redundant in this context . Both articles include the rhetorical elements of ethos, pathos and logos to support their arguments. It is clear however, which is the stronger argument. Winters usage of ethos to support his arguments is poorer than Gallaghers as he is more biased and appears less credible than Gallagher. However, Winter effectively uses pathos to sway the audience in his argument as he includes specific examples. Though Gallagher does try to persuade his audience in this way, he is still lacking in the element of pathos. Logos plays an important role in any argument and though both authors have strengthened their arguments with this rhetorical proof, Gallagher does a better job at logically reasoning with the audience. He supports his claims with suitable evidence and makes some very good points. Winter has points that are refutable because he is guilty of fallacies in his arguments. In conclusion, Gallagher presents the better argument when he proves that video games are not to blame for violent t endencies amongst children and that the rating system will help prevent children from playing mature games. EU Competition Law and Economics

EU Competition Law and Economics Discuss the use of terms drawn from economics in the jurisprudence of the European Court of Justice, which relate to the interpretation of Articles 101 and 102 of the Treaty on the Functioning of the European Union. Examine, in particular the role such terms play in the legal argument. This essay will examine the economic theories, both from a classical point of view and neo-classical to determine the underpinnings of competition law. Through the works of Adam Smith regarding monopolies in the Wealth of Nations[1] and John Stuart Mill through his theories on restraints of trade in On Liberty[2] this will demonstrate some economic objectives in pursuing laws regarding competition law. This will be supplanted with the neo-classical theories that have given more reasons through economic terms for laws regarding competition. This will provide a bedrock for an analysis of Articles 101 and 102 of the Treaty on the Functioning of the European Union (TFEU), which have been noted as the two principal Articles dealing with competition law in the European Union (EU).[3] The fundamental reason for having competition law in the EU is to allow for a flourishing free market and to ensure that corporate enterprises do not have undue influence or dominance in the market or even thr ough political influence.[4] This analysis of Articles 101 and 102 of the TFEU through the cases that have come through the Court of Justice of the European Union (CJEU) will be looked at through the prism of the economic theories that have been outlined. By looking at it through that prism, it will allow for a determination in terms of whether the role of the economic terms are brought into the legal arguments. It has been suggested that the lawyers and the economics are co-pilots of the competition law aeroplane[5] and this essay will determine whether that is true by looking at the economic theories and the cases through the EU framework on competition law. Economic Theory and Competition Law Prior to delving into how competition law has adopted economic terms and theories, it is imperative to understand how economics operates vis-Ã  -vis competition law. The classical economic theories, as noted by John Stuart Mill state that it is through competition that the political economy can have a scientific basis through which wages, rent and prices can be regulated. Whilst Mill does not provide a definition on what he meant by competition his theory on what laws surrounding competition could achieve were indicative. Smith took this further in Wealth of Nations when he stated it is the right of every man to enter into competition with any other man insofar as it does not violate the laws of justice and the idea of competition was to ensure that those in business bought dearer and sold for cheaper rather than having a monopoly with the opposite occurring. This theory was noted as a statement of perfect competition. This demonstrates the classical theories that exist but as time as gone on there have been neo-classical theories that give more defined responses. In terms of the neo-classical theories, the USA has seemingly stated that competition law should be interpreted solely through what the theories in economics dictate;[6] however, this is questioned in the EU structures. The competing views in the EU look at the efficiencies as well as other concerns such as the environment and the effect on employment.[7] In terms of taking into account the outcome of having perfect competition, it has been stated that allocative and productive efficiency is achieved which leads to the maximisation of social welfare.[8] In terms of allocative efficiency this is an economic term that means the resources will be allocated to different goods and services but will be divided insofar as it remains privately profitable to do so.[9] The second is that of productive efficiency which means that goods and services in society will be produced at the lowest cost.[10] In this regard, competition is seen as beneficial for the productive efficiency because if monop olies exist then it is likely that they will be high cost producers and they can pass that on to the consumer.[11] A third efficiency has been put forward that explains the need for competition, that being dynamic efficiency which cannot be accurately proved[12] but states that competition allows for products to be developed and created to gain the custom of consumers. This theory, in all but name, had been put forward by Smith when he stated that competition allows for new improvements of art[13] showing that this efficiency has long been spoken of. This has been questioned as monopolies have the money to carry out research[14] and where there are monopolies others will try to intervene to get their custom.[15] On this basis, how the EU and CJEU have dealt with situations where monopolies arise must be examined to determine whether the economic terms have led to the decision that has been made. Article 101 TFEU In terms of Article 101 of the TFEU, this is designed to ensure that restrictive practices are deemed incompatible with the common market. The restrictions that are placed on undertakings, which cover all entities that are involved in business,[16] have been seen to be circumvented for a number of reasons. In the case of Wouters Others v Algemene Raad van de Nederlandse Orde van Advocaten[17]it was held that despite a restriction on the legal profession, it was pursuing a legitimate objective in ensuring proper legal practice and therefore was allowed. It has been noted that this idea of a legitimate objective will stay within the competition law of the EU,[18] however, it is what constitutes a legitimate objective that can have implications for economic terms being used in the CJEU. In terms of a finding a legitimate objective, it has been noted that it is not necessary to look at the economic and non-economic objectives as they often go hand in hand.[19] In cases involving profess ional services such as Wouters and other cases such as Asnef Equifax[20]it was noted that the CJEU took into account the issue of information asymmetry whereby despite the fact that there is a restriction on competition which could increase the cost the consumer, the quality will go up which is especially prevalent in professional services.[21] These decisions tend to go against the productive efficiency in that the cost will go up by allowing increased restriction on trade in professional services, however, the allocative efficiency would be seen to improve as the quality given to the consumer improves. This demonstrates that Article 101 of the TFEU has taken the economic viewpoint into account in ensuring that the Treaty does not act rigidly vis-Ã  -vis competition law. The mechanism of Article 101 has not completely followed the economic arguments and this is seen with cases involving free riders. This was seen in the case of Consten and Grundig v Commission[22]which involved Consten who was to be the exclusive distributor in France of Grundig electrical goods with the effect that free riders, who would wait for Consten to promote the goods before then selling the Grundig electrical goods at a lower price than Consten.[23] The free rider economic system has been allowed in the United States of America in the case of Continental TV v GTE Sylvania[24] on the basis that it was economically sound. However, this was rejected in Consten on the basis that the fundamental objective of the EU plan is to have greater integration within the single market and not just to increase consumer protection and welfare.[25] Indeed, in the more recent case this viewpoint was reaffirmed in the case of GlaxoSmithKline v Commission[26]where the guidance from the EU was co nsidered and it was noted that companies are not allowed to establish private barriers within the single market of the EU.[27] These decisions from the CJEU demonstrate that whilst the economic considerations have to be taken into account, they are secondary to the fundamental aim of the EU project to have ever closer Union[28] and to ensure that there are no private barriers within the single market. To compare this to the co-pilot analogy at the beginning of this essay, these decisions would suggest that the policy makers of the EU are the pilots and the lawyer and economist are mere passengers. It must be noted that Article 101 has a defence mechanism at 101(3) which is primarily based on the economic considerations that have been outlined. This defence is for a defendant to prove but all agreements made are eligible to qualify under Article 101(3) if the requirements are met.[29] The requirements state that technical and economic progress must be improved which links with the dynamic efficiency theory of competition law economics.[30] The other requirements involve not eliminating competition on the market as well as ensuring that consumers receive a fair share of the benefits from the agreement. This ties in with Smiths theory on monopolies and improving the market through competition laws as well as the allocative and productive efficiencies noted in the more neo-classical theories regarding economics and competition law. Indeed, this defence under Article 101(3) has been given a wide interpretation as seen in CECED[31]where the economic efficiencies were central to the judgment in declaring that the environmental benefits had to be looked at in terms of their effect on the consumer.[32] As this defence is couched in terms that are readily identifiable with the economic theories, it demonstrates that the economic terms have a huge role in competition law within the EU. Article 102 TFEU In terms of Article 102 of the TFEU, its whole basis is in economic terms as it is designed to stop dominance and abuse. The use of the term dominance in economics is deemed to be wider than that of a monopoly[33] and is a position of economic strength that prevents effective competition being maintained.[34] This type of dominance goes beyond just a single entity and the CJEU can look at more than one economic enterprise to see whether there is dominance, with what is known as collective dominance.[35] In this regard, the economic term of collective dominance and dominance generally was indicative in the case of Italian Flat Case to show that there was a breach of Article 102.[36] The second economic term alongside dominance in Article 102 is that of abuse, which is where a dominant entity can use its economic strength to obtain more benefits that it would have if it was a smaller entity.[37] The use of economic terms in Article 102 cases can be seen when abuse is discussed. Article 102 makes reference to unfair prices but the CJEU has looked beyond this to see situations where there has been predatory pricing[38] and excessive pricing that look at economic terms in terms of how undertakings with great economic strength may attempt to price their competitors out of the market.[39] This tends to demonstrate that there are some economic terms that are used not only in Article 102 itself but also by the CJEU in its interpretation of the Article. However, this view has not been completely replicated across the spectrum. The use of the economic terms in invoking Article 102 has been seen as haphazard[40] and this can be seen through the cases where there has been some reliance on economic terms such as predatory pricing noted above but there are others where it has been based more on the legal concepts such as where there is commission attached for selling a certain brand.[41] In this regard, when Article 102 is looked at solely it can be seen that it is couched in economic terms such as dominance and others have come in through cases such as predatory pricing but when it is compared to its counterpart, Article 101, the effect of economics on its interpretation has not been as widespread.[42] Accordingly, when it comes to the aeroplane analogy with Article 102 it is very much that the lawyer takes the chief pilots role whereas the economist operates as a co-pilot that attempts to bolster any legal arguments that have been made. Conclusion This essay has examined EU Competition Law to determine whether the role of economics or law is prevailing in its application. The economic theories, both classical and neo-classical, demonstrate that the basis for competition law is allowing a free market to ensure that the consumers are able to receive products at a low price and other individuals are able to compete with the larger firms. In relation to Article 101 it can be seen through the use of legitimate aim and the defence given in Article 101(3) that the economic terms have a great role to play in how the case would be decided by the CJEU. However, as noted with the free rider cases such as Consten it is readily identifiable that the economics will only be taken into account after the fundamental aim of the EU, that being ever closer Union, is dealt with. This shows that the economic terms as well as the legal terms are very much secondary to the fundamental aims of the EU project. When the policy issue is put to one side, it can be seen that the economic terms and the legal terms in deciding a competition law case under Article 101 are co-pilots ensuring that the correct decision is made. In terms of Article 102, the use of economics has not been as prevalent as with Article 101 but this is largely due to the fact that there is a lack of a general theme. Perhaps as the law develops vis-Ã  -vis Article 102, the economic terms will have a greater role to play.
